How Old Do You Need to Be to Buy CBD?

If you’ve found yourself asking “How old do you need to be to buy CBD products?”, we’ve got answers.

Generally, you need to be 18 years old to purchase CBD products, but there is actually no federal age restriction in place. The age limit for buying CBD changes by state, product type, and purchasing location, and in most cases it’s up to the seller.

We’ll dive into the legal age for buying CBD products and general CBD legality below:

Key Takeaways

  • There are no specific age requirements for CBD in many areas, but the general rule is that you need to be at least 18 years old to buy CBD tinctures and edibles and at least 21 years old to buy flower, vapes, and other smokables.
  • If you intend to buy CBD in a cannabis dispensary, you need to be 21 years old.
  • Before you buy CBD in stores or online, there are a few things to look for to ensure you are buying a high-quality, safe product.

Is CBD Legal?

Before we can dive into the legal age for buying CBD, let’s discuss some CBD basics. Mainly, is CBD even legal? And if so, how do the laws concerning buying age vary across the country?

Luckily, CBD is legal on the federal level thanks to updates in the 2018 Farm Bill that clarified the unique difference between hemp and marijuana (hint: hemp has less than 0.3% Delta-9-THC).

Because CBD is derived directly from legal hemp material, it’s also legal–federally, at least. Every state has different CBD laws, and some states restrict CBD entirely, while others only restrict some product types, like products intended for smoking.

The general consensus in the majority of states, however, is that CBD is legal for adult use. State laws don’t always address the legal purchasing age, however, which leaves it up to the seller.

What’s the Legal Age to Buy CBD?

So, in a nutshell, CBD is legal in most places, but how old do you have to be to buy CBD?

Generally, you can buy CBD at 18, but not always.

As we mentioned earlier, the general age for buying CBD products is 18 years or older, but this isn’t a consistent rule. That’s because there are actually no legal age requirements set forth by the federal government, but there may be varying state laws that set age restrictions for buying CBD products. (You can check the CBD laws in your state in our State by State Guide to CBD Laws.)

Plus, the minimum age for buying CBD will change depending on the type of CBD you intend to purchase and where you intend to buy it.

For instance, most CBD tinctures and edibles are available to consumers who are at least 18 years of age, but you usually need to be 21 to purchase CBD vaporizers, flower, or other products intended for smoking.

If you want to buy CBD at a medical cannabis dispensary, you’ll need to be 21 years old unless you have a medical cannabis card that qualifies in the state.

How do stores verify age when buying CBD?

Usually, brick and mortar stores in your state will ask for proof of I.D. to verify that you meet your minimum age requirements, and online CBD stores will ask you to input your age to verify that you are at least 18 years old, and in some cases 21.

How to Find Good, Legal CBD Products

After you’ve determined that you’re of legal age to buy CBD in your area, you can start the search for high-quality CBD products. Unfortunately, this isn’t always so easy since there’s not much consistency in CBD regulation across the country.

That means that while safe, effective CBD exists, so do low-quality, potentially harmful formulas. There are some steps you can take to determine if a CBD product is worth your money before you actually spend it. When you get ready to buy a CBD product, whether in stores or online, look for:

  • Products made from U.S. grown, premium-quality industrial hemp. Avoid brands that don’t specify their hemp source.
  • Brands that are transparent and use current Good Manufacturing Practices, which are the manufacturing standards that are suggested by the FDA to be safest and most effective in producing quality products.
  • Third-party test results. Brands who have nothing to hide will always provide a Certificate of Analysis for every product batch. These tests should show information that accurately matches the product’s label.

Ask a Stoner: Is There an Age Requirement to Buy CBD Products?

Dear Stoner: Does someone have to be eighteen to buy CBD products? What if they’re made from hemp? I see some in dispensaries and others in regular stores.
J.W.

Dear J.W.: Cannabidiol (CBD) products made from plants grown in a licensed marijuana cultivation can only be purchased at dispensaries, which are open to adults 21 and up and medical patients. However, a cannabis plant with no more than 0.3 percent THC is considered hemp by the federal government, so products from that plant can be sold in all fifty states. Despite their low THC content, hemp plants can still be rich in CBD. Although there are concerns about the long-term effects of hemp-derived CBD, and completely removing THC from medication isn’t always the right therapeutic decision, it’s great to at least see some form of CBD available to patients in non-legalized states.

You can find hemp CBD products at a variety of health stores, food markets and trendy boutiques, as well as smoke and vape shops that sell vaporizer cartridges with CBD oil. There’s no law against selling any of those, including vaporizer cartridges, to minors, but it’s still up to the business. Most smoke shops don’t even allow minors inside, and some require that you be 21 or older to buy CBD products.

“Online, however, is open season,” notes cannabis public-relations expert Emalee Hyde, who counts hemp-CBD vaporizer company Veedverks among her clients. “Any six-year-old with access to Mom and Dad’s account could order hemp-derived CBD.”

What is the minimum age required to buy CBD in NYC?

This is a frequently asked question that our customers in various states ask in order to purchase hemp and CBD products. However, there have been changes in the legality of hemp and CBD products in recent years.

Some common questions people ask are: Is CBD legal in New York? Is it allowed to use CBD for recreational purposes? How old do you have to be to buy CBD in the state? These are all good questions and we will answer them in this article.

Is CBD legal in New York?

Yes, it is legal, CBD derived from hemp is available in New York, but its use is subject to strict regulations by the New York Department of Agriculture and Markets. CBD is not allowed in addition to food or drink, but it is for sale as a lotion, ointment or balm. The New York State Legislature passed a comprehensive regulatory framework around the licensing, manufacture, sale, and use of hemp and CBD in June 2019.

Cannabis-derived CBD can be legally accessed only if individuals possess a valid New York State Medical Marijuana program card. Medical cannabis has been legal since 2014 in the state of New York.

What is CBD?

CBD stands for cannabidiol, a non-intoxicating substance found in cannabis. CBD is the second most prominent cannabinoid in cannabis after THC, which has an intoxicating or psychoactive effect. CBD can be obtained from marijuana or hemp plants and has a wide range of purported therapeutic benefits, such as reducing pain, inflammation, and anxiety, and suppressing seizures. Since the cannabinoid has gained considerable attention for its therapeutic properties, more CBD-rich strains have recently been cultivated.

Why is CBD sometimes illegal?

Under the Federal Controlled Substances Act of 1970, all types of Cannabis were classified as illegal, including strains of hemp that do not produce enough THC to cause intoxication. Until then, no substance from cannabis was accepted for any accepted medical use known as list 1.

In 2018, the Agricultural Law reclassified Cañano as an agricultural product and legalized its cultivation at the federal level. The law removed some forms of cannabis from the state from List 1 and creates a legal distinction between hemp and marijuana. Hemp is cannabis with less than 0.3% THC and marijuana refers to cannabis with more than 0.3% THC. With this, the law legalized CBD because it is derived from cannabis with less than 0.3% THC, as long as it has been cultivated with state and federal regulations. However, it does not mean that CBD is universally legal throughout the United States under the 2018 Farm Bill legislation.

The Food and Drug Administration (FDA) has the power to regulate the labeling of CBD products, including therapeutic claims and the use of CBD as a food additive. The FDA maintains that CBD cannot legally be added to foods and beverages, or marketed as a dietary supplement. The agency has also been strict in its position against any labeling that could be perceived as medical claims about CBD. The Farm Bill also gave states the option to regulate and prohibit the cultivation and trade of CBD. New York is a state that has its own regulatory framework for CBD, adopting some FDA directives and avoiding others.

New York CBD Laws

In June 2019, Bill S6184A, also known as the hemp law, was approved by the New York State Senate with legislation that provides a comprehensive regulatory legal framework for Hemp and CBD.

Some notable amendments to the June 2019 hemp bill include:

The New York State Department of Agriculture and Markets has authority to regulate the production, processing, packaging, and labeling of hemp extract products sold in New York State.
Retailers, wholesalers, and manufacturers selling hemp-derived cannabis products must apply for a cannabinoid permit.
The sale of hemp extract from another state intended for human and animal consumption is prohibited, unless it complies with New York standards and regulations, which will be enacted in the future.
All hemp extracts must be packaged and labeled in accordance with New York Department of Agriculture and Markets standards and display a supplemental information panel where applicable, along with a QR code setting out other relevant information. No product can advertise therapeutic claims.

Currently the New York State Department of Health and Agriculture is implementing a general enforcement strategy to prevent illegal CBD products from being marketed. Penalties for CBD-infused foods and beverages include voluntary disposal, seizure or destruction of the product, a fine, and failure to conduct a health inspection. CBD oils, lotions, salves, and other topical applications are legal for everyone.

New York CBD Possession Limits

In New York State, there are currently no possession limits for hemp-derived CBD products. Although Cannabis was decriminalized to some extent in New York in August 2019, those in possession of CBD products derived from cannabis may be subject to penalties. Medical marijuana patients can legally possess a thirty-day supply of non-smokable, non-edible cannabis-derived CBD products.

What is the age required to purchase CBD products for New Yorkers?

Anyone over the age of 21 is legally allowed to purchase CBD without restrictions in New York State. Federal law does not place restrictions on forms of CBD such as topicals, oils, gummies, and creams.
